Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the Shipmuch platform, website, APIs, software, infrastructure, deployment services, and related offerings (collectively, the “Services”).
Shipmuch is a product and service operated by TORIS Technologies (Pty) Ltd (“Shipmuch”, “we”, “us”, or “our”), a company registered in the Republic of South Africa.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
2. Eligibility
You must:
- be at least 18 years old;
- have the legal authority to enter into these Terms;
- and comply with all applicable laws and regulations when using the Services.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Description of Services
Shipmuch provides a hosted deployment and infrastructure management platform that enables users to:
- deploy applications from source repositories;
- orchestrate deployments to Kubernetes environments;
- manage runtime infrastructure;
- configure domains and ingress;
- manage deployment operations;
- monitor workloads;
- and access related operational tooling.
The Services may include:
- web applications;
- APIs;
- deployment automation;
- infrastructure orchestration;
- billing systems;
- logging systems;
- administrative tooling;
- and beta or experimental features.
4. Accounts and Workspace Responsibility
You are responsible for:
- maintaining the confidentiality of your account credentials;
- all activity occurring under your account or workspaces;
- all deployments initiated through your account;
- and all users granted access to your organization or workspace.
You agree to immediately notify us of:
- unauthorized access;
- credential compromise;
- or security incidents related to your account.
5. Customer Content and Code
You retain ownership of:
- your applications;
- repositories;
- deployment artifacts;
- source code;
- databases;
- and all content uploaded or deployed through the Services (“Customer Content”).
You grant Shipmuch a limited license to:
- host,
- process,
- deploy,
- transmit,
- and manage Customer Content
solely for the purpose of providing the Services.
You are solely responsible for:
- the legality of your applications;
- the security of your code;
- all deployment behavior;
- and any consequences arising from your workloads.
6. Prohibited Activities
You may not use the Services to:
- distribute malware;
- perform unauthorized scanning;
- conduct phishing activities;
- operate botnets;
- mine cryptocurrency without authorization;
- distribute illegal content;
- violate intellectual property rights;
- attack infrastructure;
- bypass security restrictions;
- interfere with platform stability;
- or violate applicable laws.
Shipmuch reserves the right to suspend or terminate any account engaged in prohibited activities.
7. Infrastructure and Deployment Responsibility
Shipmuch provides deployment orchestration and infrastructure automation services.
You acknowledge that:
- distributed systems may experience outages;
- deployments may fail;
- infrastructure interruptions may occur;
- and runtime environments may experience instability.
Shipmuch does not guarantee:
- uninterrupted availability;
- error-free operation;
- or perfect deployment outcomes.
You are responsible for:
- validating deployments;
- maintaining backups;
- implementing disaster recovery procedures;
- and monitoring your applications.
8. Service Availability
We aim to maintain reliable platform availability but do not guarantee uninterrupted or continuous access.
Maintenance, upgrades, incidents, scaling operations, third-party provider failures, or force majeure events may affect service availability.
Scheduled maintenance windows may occur without liability.
9. Beta Features
Shipmuch may provide beta, preview, experimental, or early-access features.
Beta features:
- may be unstable;
- may change without notice;
- may be discontinued;
- and may not be suitable for production workloads.
Beta features are provided “as is” without warranties or guarantees.
10. Billing and Payments
Certain Services may require payment.
By purchasing paid Services, you agree to:
- provide accurate billing information;
- authorize recurring charges where applicable;
- and pay all fees associated with your usage.
Shipmuch may:
- suspend Services for unpaid balances;
- change pricing;
- modify billing structures;
- or introduce usage-based pricing models.
Unless otherwise required by law, fees are non-refundable.

11. Intellectual Property
The Shipmuch platform, branding, software, infrastructure systems, documentation, interfaces, and related materials are owned by TORIS Technologies (Pty) Ltd and protected under applicable intellectual property laws.
These Terms do not grant you ownership of the Services.
12. Security
Shipmuch implements commercially reasonable technical and organizational security measures.
However, no infrastructure platform can guarantee absolute security.
You acknowledge and accept the inherent risks associated with:
- cloud infrastructure;
- distributed systems;
- internet-connected deployments;
- and third-party integrations.
13. Third-Party Services
The Services may integrate with third-party providers including:
- GitHub;
- cloud providers;
- registries;
- DNS providers;
- analytics providers;
- and payment processors.
Shipmuch is not responsible for:
- third-party outages;
- API failures;
- data loss caused by third parties;
- or external service disruptions.
14. Suspension and Termination
Shipmuch may suspend or terminate access to the Services:
- for violations of these Terms;
- security threats;
- abusive behavior;
- illegal activity;
- unpaid invoices;
- or operational risk.
You may stop using the Services at any time.
Termination does not remove obligations related to:
- outstanding fees;
- legal liability;
- or prohibited conduct.
15. Limitation of Liability
To the maximum extent permitted by law:
Shipmuch and TORIS Technologies (Pty) Ltd shall not be liable for:
- indirect damages;
- consequential damages;
- loss of profits;
- loss of revenue;
- deployment failures;
- infrastructure outages;
- loss of data;
- business interruption;
- security incidents;
- or operational disruptions.
Our total aggregate liability under these Terms shall not exceed the amount paid by you to Shipmuch during the preceding three (3) months.
16. Indemnification
You agree to indemnify and hold harmless Shipmuch, TORIS Technologies (Pty) Ltd, its directors, employees, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from:
- your deployments;
- your applications;
- your violation of these Terms;
- your misuse of the Services;
- or your infringement of third-party rights.
17. Privacy
Your use of the Services is subject to our Privacy Policy.
18. Changes to the Services
Shipmuch may:
- modify features;
- discontinue functionality;
- update APIs;
- introduce limits;
- or change operational requirements at any time.
We may also update these Terms periodically.
Continued use of the Services constitutes acceptance of updated Terms.
19. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

21. Entire Agreement
These Terms constitute the entire agreement between you and Shipmuch regarding the Services and supersede prior agreements or understandings.
22. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
23. No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.
