This Infrastructure & Platform Disclaimer (“Disclaimer”) applies to the Shipmuch platform, deployment systems, APIs, infrastructure services, orchestration systems, websites, and related offerings (collectively, the “Services”).

Shipmuch is operated by TORIS Technologies (Pty) Ltd (“Shipmuch”, “we”, “us”, or “our”).

By using the Services, you acknowledge and accept the risks, limitations, and operational characteristics described in this Disclaimer.

2. Nature of the Services

Shipmuch provides:

deployment orchestration;
infrastructure automation;
Kubernetes-related operational tooling;
runtime management systems;
deployment workflows;
and related platform services.

The Services involve:

distributed systems;
cloud infrastructure;
third-party integrations;
automated orchestration;
and dynamic operational environments.

As a result, interruptions, failures, delays, and operational inconsistencies may occur.

3. No Guarantee of Continuous Availability

Shipmuch does not guarantee:

uninterrupted platform access;
continuous deployment availability;
zero downtime;
instant deployment execution;
or uninterrupted runtime operation.

Platform availability may be affected by:

infrastructure failures;
maintenance;
cloud provider outages;
networking disruptions;
scaling events;
third-party dependencies;
security incidents;
or operational limitations.

4. Deployment Risks

Customers acknowledge that deployments may:

fail;
partially complete;
experience configuration issues;
encounter dependency conflicts;
or produce unintended operational behavior.

Shipmuch does not guarantee:

successful application deployment;
workload stability;
runtime correctness;
or production readiness of customer applications.

Customers remain solely responsible for:

validating deployments;
testing workloads;
and verifying operational outcomes.

5. Customer Code Responsibility

Customers are fully responsible for:

source code;
application logic;
dependencies;
runtime behavior;
infrastructure configurations;
environment variables;
and deployment settings.

Shipmuch does not review, audit, or certify customer applications for:

security;
stability;
legality;
or operational correctness.

6. Kubernetes & Infrastructure Complexity

Shipmuch abstracts portions of Kubernetes and infrastructure management complexity.

However, customers acknowledge that:

container orchestration systems are inherently complex;
distributed systems may behave unpredictably;
infrastructure reconciliation may fail;
and operational conditions may vary across environments.

Infrastructure automation does not eliminate operational risk.

7. Third-Party Dependencies

The Services depend on third-party providers including:

cloud infrastructure providers;
GitHub;
DNS providers;
registries;
networking providers;
and monitoring systems.

Shipmuch is not responsible for:

third-party outages;
provider failures;
API disruptions;
DNS propagation issues;
registry failures;
or external infrastructure instability.

8. No Warranty

To the maximum extent permitted by law, the Services are provided:

“AS IS”

and

“AS AVAILABLE”

Shipmuch disclaims all warranties including:

implied warranties of merchantability;
fitness for a particular purpose;
non-infringement;
operational continuity;
and infrastructure reliability guarantees.

9. Security Limitations

While Shipmuch implements commercially reasonable security measures, customers acknowledge that:

no platform can guarantee absolute security;
internet-connected systems carry inherent risk;
sophisticated attacks may occur;
and infrastructure vulnerabilities may arise.

Customers remain responsible for:

securing applications;
protecting credentials;
managing secrets;
and maintaining appropriate operational safeguards.

10. Data & Backup Responsibility

Customers are responsible for:

maintaining backups;
exporting critical data;
preserving deployment configurations;
and implementing disaster recovery procedures.

Shipmuch is not responsible for:

data loss;
corrupted deployments;
workload failures;
or operational interruptions resulting from customer actions or infrastructure events.

11. Operational Metrics & Monitoring

Any operational metrics, analytics, monitoring data, or infrastructure visibility provided through the Services:

are informational in nature;
may contain delays or inaccuracies;
and should not be relied upon as the sole operational monitoring source.

Customers should maintain independent operational monitoring where appropriate.

12. Beta & Experimental Features

Shipmuch may provide:

beta features;
preview systems;
experimental tooling;
or early-access functionality.

These features:

may be unstable;
may change without notice;
may contain defects;
and may not be suitable for production environments.

Use of beta features is entirely at customer risk.

13. Limitation of Liability

To the maximum extent permitted by law, Shipmuch and TORIS Technologies (Pty) Ltd shall not be liable for:

deployment failures;
infrastructure outages;
workload instability;
customer revenue loss;
data loss;
business interruption;
operational disruption;
security incidents;
or indirect or consequential damages.

14. Customer Operational Responsibility

Customers remain responsible for:

production readiness reviews;
deployment testing;
workload validation;
compliance obligations;
and operational oversight of their applications.

Shipmuch does not replace internal operational review, DevOps practices, or security governance.

15. Changes to This Disclaimer

Shipmuch may update this Disclaimer periodically to reflect:

infrastructure evolution;
platform changes;
operational practices;
or legal developments.

Updated versions will be published with revised effective dates.
